The Employment Handbook

The core product is the Employment Policy and Handbook. This document is geared to providing the professional who is unsophisticated in the legal arena with a step-by-step process that (1) creates an atmosphere of certainty in the employment relationship, and (2) minimizes or completely eliminates risk of litigation or other legal issues with former employees or unsuccessful applicants.

There are many policies and procedures that are being offered today, but none we know of approach the utility of this document, for four reasons. First, none was conceived in the crucible of real world litigation. Second, the Vision policy is affirmative, rather than punitive. Third, the policy is customized to your needs, and Fourth, the policy is supported by your immediate access to expert advice and guidance through membership in our Solution Center.

A robust employee concern reporting component of the policy gives employees confidence that grievances will be heard and documented. Discipline is affirmative, in that it is structured to lead the employee into buying into her need to correct behaviors. Moreover, if behaviors do not change, and the employee is terminated, the documentation created effectively prevents successful claims against you and your practice.

A central component of the policy is the delivery of forms which correlate with each step in the process of hiring, review, discipline and separation of employees.

Upon receipt of an order for the policy, we make contact with you, your team leader or office manager. The Handbook template is provided, and in telephone and e-mail exchanges, the document is customized to your needs. You receive the hard copy and electronic media Policy in a binder, along with up to five (5) Employee Handbooks, each of which contains duplication of the
management policies.

Additional Handbooks are provided at an additional charge.

    Alternative Dispute Resolution Policy

If you should have an employee legal claim, the time and money you may want to put in the defense can easily exceed $50,000.00. Mediation and arbitration can save you a great deal of time and money, and may also discourage a claim that would otherwise be made. Alternative Dispute Resolutions [ADR], which commits any claim to binding arbitration in lieu of a court proceeding and trial, has been approved in every state.

Key features of the Vision Policy:

  • administration of the mediation and arbitration by the American Arbitration Association
  • a policy tailored to your state and needs
  • organized to bind every employee to the policy
  • full support from Vision – if a claim is made, we guide you in the implementation of the policy, and arrange for expert local lawyers to assist you

    Investigation Support

If you do receive a complaint that cannot be effectively dealt with by consultation, and requires a more thorough investigation, Vision provides that service. Independent investigation of complaints by Vision HR will eliminate challenges to the results of an investigation done internally by the practice. If your first notice of a problem is the receipt of a charge of discrimination from the Equal Employment Opportunity Commission [“EEOC”] or an equivalent state agency, the need for a reasoned, comprehensive investigation and response is paramount.

At the conclusion of any investigation, Vision provides a full report, with recommendations, to the practice. These services are priced according to the time and investment by Vision HR.

    Crisis Consulting Onsite

Even the best practice or business can be faced with a crisis in employment relations – the staff member who becomes threatening, intimidating or even potentially dangerous and must be separated on an emergency basis. We’ve seen this all too often, and the potential for exposure to liability from patients, customers or even co-workers, or from the employee herself, is a real concern.

Should you be faced with this situation, Mike is available to come to your office, prepare you and your staff for the termination meeting and to be with you to guide you through this process and its aftermath.

We can also set up a telephone or web video conference so that Mike can assist you from our offices in Tucson, and provide the guidance you need to avoid the unfortunate consequences of a termination gone wrong.
